The federal content limit on a hair styling product is not in the food and drug title. It is in title forty, Protection of Environment, under the Clean Air Act, and it has been since December 1998. Its table sets a weight-percent limit of eighty for hairsprays, sixteen for hair mousses and six for hair styling gels, and the subpart defines each of the three. Across three hundred and seventeen thousand characters of that part the phrase hair wax appears zero times and pomade zero, while the bare word wax appears fifteen times and nearly all of them are floor wax. The definition of a consumer product opens at its widest and then closes, in its second sentence, to the two tables.

The argument

Eighty, sixteen, six. Three hair products in the federal VOC table, three definitions, and a phrase that is not in the part at all.

Start with where the rule actually lives, because almost everyone in this category looks in the wrong title. The authority note on the part reads, in its entirety, 42 U.S.C. 7414 and 7511b(e), which are the Clean Air Act's information-gathering section and its consumer and commercial products section. The subpart applies to consumer products manufactured or imported on or after December 10, 1998, and its neighbor in the same part is the standard for architectural coatings.1 Its central definition opens about as wide as a definition can: any household or institutional product, substance or article, including any container or packaging, whose use, consumption, storage, disposal, destruction or decomposition may result in the release of VOC.2 And then the very next sentence closes it: for the purposes of the subpart, the term means any product listed in tables 1 or 2. Twenty words, and they settle the scope.3 The exclusions the subpart writes for itself are seven, and every one turns on destination, chemistry, composition or a single named use rather than on a category of product.4 Three things in the printed text do not resolve cleanly, and because this page claims primary-source accuracy, all three are set out, including the one that checks out.5

Then the table. Three hair rows sit consecutively in it: hairsprays at 80, hair mousses at 16, hair styling gels at 6, as a weight-percent of the product, and the spread between the loosest and tightest is more than thirteen times.6 Each has a definition of its own. A hair mousse is a hairstyling foam designed to facilitate styling and provide limited holding power, which is eighteen words turning on a form and a performance term that the subpart never defines.7 A hair styling gel is a high-viscosity, often gelatinous product that contains a resin, where the texture word is qualified by often and the viscosity word is not.8 A hairspray is designed primarily for dispensing droplets of a resin to impart sufficient rigidity for a period of time, which is a purpose test and a delivery test together, and says nothing about aerosols.9 All three reach for the same unusual word, and across the whole of title forty that word appears in exactly one section.10

The part was pulled whole and searched. Across 317,510 characters, the exact phrase hair wax returns zero, pomade returns zero and hair shine returns zero, while the bare word wax returns fifteen and they are entries like wood floor wax at 90, which is why only phrase counts are printed here.11 Read as tests rather than as descriptions, the three definitions ask three different first questions: is it a foam, is it high-viscosity and resin-containing, is it designed primarily to dispense droplets.12 And the closing sentence of the definition, read from the other end, says that inside this subpart the question of what counts is answered by looking at two tables, one with about forty entries and one with two.13 What does not follow from any of that is set out in the middle of the argument rather than buried at the end: not that a hair wax is unregulated, not that it is exempt, not that any real product is inside or outside any definition, and not anything at all about why the three categories are the three.14 Set against the rest of the table, from shaving creams at 5 to wood floor wax at 90, the three hair rows span most of the range, which no other product family in the table does.15

Last, who the subpart is talking to and what it asks of them. The regulated entity is decided by the package: the maker or importer always, plus any distributor named on the label, and a distributor not named is not a regulated entity, which the paragraph states expressly rather than leaving to inference.16 The container must clearly display the day, month and year of manufacture or a code indicating that date, with one exception for free samples, and the circumvention section treats that code as part of the record.17 There is a relief valve, and its standard is four words: extraordinary circumstances beyond reasonable control, applied for in writing.18 And the subpart closes with two provisions pointing opposite ways: the reports and records are not available to the public while compliance status is available on request, and a separate section says the regulation shall not be construed to preclude a State from acting, which this page quotes as federal text and takes no further.19 Fourteen further claims this page refused are published together so they can be checked.20

Not in one table is not
the same as not regulated.
We read one subpart.
We will not speak about the rest.

The three cards before this one are the most useful thing here and also the easiest to misread. This card exists to say, in the middle of the lane rather than only at the end, exactly what does not follow.

THE REFUSAL, PRINTED IN THE LANE IT BELONGS TO RATHER THAN ONLY ON THE LAST CARDREFUSED
01That a hair wax is unregulated. We searched one part of one title. There are fifty titles, and this page read nothing in forty-nine of them.
02That a hair wax is exempt from this subpart. Exempt is a legal conclusion, and the subpart has its own exclusions at 59.201(c) which are quoted on card 04. We do not place anything inside or outside them.
03That any real product is or is not within any of the three definitions. That is a question about a formula and a design purpose, and it is answered by people who can see both.
04That the absence means anything at all about why. We do not know why the three categories are the three, we did not read the 1998 rulemaking record to find out, and we will not guess at a drafter's intent from a word count.
WHAT THIS PAGE DOES SAY IS NARROW AND CHECKABLE: THE TABLE NAMES THREE HAIR CATEGORIES, THE SUBPART DEFINES EACH OF THE THREE, THE PHRASE THIS DOMAIN IS NAMED FOR DOES NOT APPEAR IN THE PART, AND THE DEFINITION CLOSES TO THE TABLES. EVERYTHING BEYOND THAT IS SOMEBODY ELSE'S WORK.WHAT IT DOES SAY

Whose Name Is On The Label

The provision that decides who the rule is addressed to
🔒 myhairwax.com

A distributor named on
the label is a regulated
entity. One not named
is not. It turns on the printing.

Before anything about limits, the subpart settles who it is talking to, and it settles it by looking at the package. The rule is short, it is explicit in both directions, and it has a fallback.

40 C.F.R. 59.201(b), DESIGNATION OF REGULATED ENTITY, QUOTED WHOLE · READ OCTOBER 4, 2026PRIMARY SOURCE
The regulated entity is: the manufacturer or importer of the product; and any distributor that is named on the product label. The manufacturer or importer of the product is a regulated entity for purposes of compliance with the volatile organic compounds (VOC) content or emission limits in sec. 49.203, regardless of whether the manufacturer or importer is named on the label or not. The distributor, if named on the label, is the regulated entity for purposes of compliance with all sections of this part except for sec. 59.203. Distributors whose names do not appear on the label are not regulated entities. If no distributor is named on the label, then the manufacturer or importer is responsible for compliance with all sections of this part.40 C.F.R. 59.201(b), QUOTED WHOLE. THE REFERENCE TO sec. 49.203 IS AS PRINTED; SEE CARD 05.
IT STATES THE NEGATIVE EXPRESSLYMost drafting defines who is covered and leaves the rest to inference. This paragraph writes the exclusion out: a distributor not named on the label is not a regulated entity. That sentence is doing as much work as the one before it.WRITTEN OUT
AND THE OBLIGATIONS SPLITThe maker or importer carries the content limits whatever the label says. A named distributor carries everything else. If nobody is named, the maker or importer carries all of it. Three arrangements, from one printed line.A SPLIT DUTY

One section of the subpart is about the package itself. It is three sentences long, it requires a date or a code standing for one, and it has a single exception.

40 C.F.R. 59.205, LABELING, QUOTED WHOLE · READ OCTOBER 4, 2026PRIMARY SOURCE
The container or package of each consumer product that is subject to this subpart shall clearly display the day, month, and year on which the product was manufactured, or a code indicating such date. The requirements of this provision shall not apply to products that are offered to consumers free of charge for the purposes of sampling the product.40 C.F.R. 59.205(a), QUOTED WHOLE.
THREE ELEMENTS, NOT A DATEThe provision names 3: the day, the month and the year. It does not say "date of manufacture" and leave the form open; it lists the parts.3

AND THE CODE REAPPEARS IN THE CIRCUMVENTION SECTIONSection 59.212 forbids altering, destroying or falsifying any record or report to conceal noncompliance, and says such concealment includes refusing to give the Administrator access to "all required records and date-coding information". A Variance Is A Written Application

Extraordinary circumstances

with three things specified.

The subpart has a relief valve. Its standard is written in four words and its procedure is a written application with a specified content, which makes it one of the more legible provisions in the part.

40 C.F.R. 59.206(a), VARIANCES, OPENING, QUOTED WHOLE · READ OCTOBER 4, 2026PRIMARY SOURCE
Any regulated entity who cannot comply with the requirements of this subpart because of extraordinary circumstances beyond reasonable control may apply in writing to the Administrator for a variance. The reports are not public.
The compliance status is,

The subpart closes with two provisions that are easy to read past. One says what the agency will and will not hand over. The other says what this regulation does not do to anybody else's authority.

40 C.F.R. 59.214(a) AND 59.211, BOTH QUOTED WHOLE · READ OCTOBER 4, 2026TWO PROVISIONS
Specific reports or records required by this subpart are not available to the public. The Administrator will, upon request, provide information as to the compliance status of a product or regulated entity.40 C.F.R. 59.214(a), QUOTED WHOLE. THE SECOND SENTENCE IS THE PART PEOPLE MISS.
The provisions in this regulation shall not be construed in any manner to preclude any State or political subdivision thereof from: (1) Adopting and enforcing any emission standard or limitation applicable to a regulated entity. (2) Requiring the regulated entity to obtain permits, licenses, or approvals prior to initiating construction, modification, or operation of a facility for manufacturing a consumer product.40 C.F.R. 59.211(a), QUOTED WHOLE. THE FULL LIST, PUBLISHED SO IT CAN BE CHECKED AGAINST EVERY OTHER CARDREFUSED
01That a hair wax is unregulated, exempt, or free of any requirement. This is the central one and it has a card of its own. We read one subpart of one part of one title.
02That any real product falls inside or outside any of the three definitions. That is a question about a formula and a design purpose, and this page answers it for nobody.
03Any advice to anybody. Not to a maker, an importer, a distributor or a buyer. No what to put on a label, no what to reformulate, no what to file.
04Anything about what any State requires, in either direction. Section 59.211 is quoted as federal text and no State's program was read or described.
05Any health, safety or environmental claim. Nothing here says VOC emissions are harmful or harmless, that any limit protects anything, or that any product is safe or unsafe.
06Any position on the policy. Not whether the limits are right, whether the categories are well drawn, or whether the rule should be updated.
07Why the three categories are the three. We did not read the 1998 rulemaking record and will not infer a drafter's intent from a word count.
08A bare-token count of the word wax. It returns 15 in the part and nearly all are floor wax. Only exact-phrase counts are printed, and card 11 says so.
09That anyone erred in the printed text. Card 05 reports three citation findings as printed, says which one resolves, and accuses nobody.
10What the part source note was meant to say. We report that volume 64 and the date September 11, 1998 cannot both be right, and we stop.
11Whether any variance has ever been applied for or granted. We did not look, and card 18 says so rather than estimating.
12Any business named, anywhere. No brand, no formulator, no contract manufacturer, no trade association, and no claim about anyone's compliance.
13Any market size, category growth rate, store count or search volume. None appears on this page, from any source.
14That any of this is complete. One part, its two tables, its definitions, and the Federal Register index for one date. We do not say no other federal instrument touches this product.
